Mini Monstars App — Terms of Use

1) Introduction

These Terms of Use (“Terms”) apply to the Mini Monstars mobile application and any related websites, pages, and platforms we operate (together, the “Platform”). The Platform is owned and operated by Mini Monstars (“Mini Monstars”, “we”, “us” or “our”).

2) Who These Terms Are For

Mini Monstars is designed for use by children under the supervision of a parent/guardian or by educators/centres where applicable. By creating an account, starting a trial, purchasing a subscription, or using the Platform, you confirm that you are a parent/guardian (or an authorised educator/centre representative) and that you agree to these Terms.

 

3) Changes to These Terms

We may update these Terms from time to time. If we make changes, we will post the updated Terms in the Platform (and/or on our website) and may request your acceptance when you next use the Platform. If you do not agree to the updated Terms, you must stop using the Platform and cancel any subscription.

4) Privacy

Our Privacy Policy explains how we collect, use, and store information, including information relating to children. The Privacy Policy forms part of these Terms. If you do not agree to the Privacy Policy, you must not use the Platform.

 

5) App Store / Google Play Terms

If you purchase a subscription through Apple App Store or Google Play, your purchase and subscription management is also subject to that provider’s terms and policies. You are responsible for reviewing and complying with those terms.

 

6) Accounts, Access and Security

• You may need to create an account to access certain features (“Account”).

• You are responsible for keeping your login details secure and for all activity that happens under your Account.

• Tell us as soon as possible if you believe your Account has been accessed without permission.

• Accounts are not transferable.

 

7) Subscriptions, Trials, Billing and Renewal

Subscriptions: Mini Monstars may offer monthly or annual subscriptions and may also offer free trials from time to time. Availability and pricing may vary by country and provider.

Auto-renewal: Unless cancelled, subscriptions renew automatically at the end of each billing period.

Managing/cancelling subscriptions:

• If you subscribed through the App Store or Google Play, you must cancel via your Apple/Google account settings.

• If you subscribed directly with us (if available), you can cancel via your account settings within the Platform or by contacting us.

No pro-rata refunds: To the extent permitted by law, we do not provide refunds for partial subscription periods once billing has occurred, except where required under Australian Consumer Law or other applicable laws.

 

8) Acceptable Use and Safety

Mini Monstars is a child-focused learning platform. You agree that you (and any child using your Account) will not:

• use the Platform in a way that is harmful, abusive, unlawful, or offensive;

• attempt to hack, bypass security, interfere with the Platform, or access areas you are not authorised to use;

• upload or transmit viruses or malicious code;

• misuse any content, lessons, videos, music, graphics, or other materials in the Platform.

We may suspend or terminate access if we reasonably believe these Terms have been breached.

 

9) Intellectual Property

All content and materials in Mini Monstars (including videos, lesson plans, activities, text, graphics, characters, animations, logos, audio, and software) are owned by or licensed to Mini Monstars and are protected by intellectual property laws (“Mini Monstars Materials”).

You are granted a limited, personal, non-commercial, non-transferable licence to use the Platform for your household (or authorised centre use where applicable). You must not:

• copy, reproduce, distribute, sell, or commercially exploit any Mini Monstars Materials;

• modify, reverse engineer, decompile, or attempt to extract source code from the Platform (except where permitted by law);

• use our logos, characters, or branding in a way that suggests endorsement or partnership without written permission.

 

10) User Content (If Enabled)

Some features may allow parents/educators to submit feedback or other content (“User Content”). You confirm you have the rights to submit that content and that it does not violate any law or anyone else’s rights.

By submitting User Content, you grant Mini Monstars a worldwide, royalty-free, perpetual licence to use it for operating, improving, and promoting the Platform (for example: to respond to feedback, improve activities, or develop features). We will handle personal information in accordance with our Privacy Policy.

 

11) Third-Party Links and Services

The Platform may include links to third-party websites or services. We are not responsible for third-party content, privacy practices, or services.

 

12) Suspension or Termination

We may suspend or terminate access to the Platform if:

• your Account is used in breach of these Terms;

• we reasonably believe it is necessary to protect children, users, or the integrity of the Platform; or

• we discontinue the Platform (in whole or part).

Where possible, we will take reasonable steps to provide notice.

 

13) Disclaimers

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we do not guarantee that:

• the Platform will be uninterrupted, error-free, or always available;

• activities will achieve any particular learning outcome for every child;

• content is suitable for every child in every circumstance (children develop at different rates).

Mini Monstars provides movement and learning resources and is not medical advice. If you have concerns about your child’s health or development, speak with a qualified professional.

 

14) Limitation of Liability

To the fullest extent permitted by law, Mini Monstars is not liable for indirect or consequential loss, loss of profits, loss of data, or loss arising from your use of (or inability to use) the Platform.

Nothing in these Terms excludes any rights you have under Australian Consumer Law (or similar mandatory consumer protections) that cannot be excluded.

 

15) Consumer Guarantees (Australia)

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage, and to have services repaired or re-supplied if they fail to be of acceptable quality and the failure does not amount to a major failure.

 

16) Governing Law

These Terms are governed by the laws of Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Australia.
